definitions:
in these terms and conditions the following words
and phrases shall have the following meaning:
‘host’ means the
person(s), firm or company to whom dinner
partease
has been hired by.
‘company’ means dinner
partease
‘confirmation of booking’
means confirmation of a provisional booking in
writing from the host or third party to the company
to be received not later than 14 days after the
provisional booking.
‘force majure event’
means any event beyond the control of the company
including (but not limited to) war (whether declared
or not), civil war, riots, terrorism, natural
disasters such as violent storms, floods and/or
lightening, explosions, fires and / or destruction
of plant, machinery and / or factories, strikes
and labour disputes of all kinds, acts of authority,
whether lawful or unlawful, except for an act
for which the company has assumed the risk by
virtue of any other provisions of this agreement,
and any lack of authorisation, licence or approval
necessary for the performance of the contract
which is to be issued by any public authority
and / or other cause whatsoever beyond the company’s
control.
‘function’ means
an event to be held within a venue or home booked
on a specific date or dates.
‘guests’ mean the
people who the host invites to attend the function.
‘guaranteed minimum’
means the minimum number of guests attending a
function as agreed between the host and the company
at the time of confirmation of booking.
‘contract’ means
the form which sets out the choice of various
consumables that the company offers to provide
the host during and in relation to the function.
‘payment request’
means the request issued by the company to the
host for payment in advance of a function or event.
‘provisional booking’
means a verbal reservation with the company for
a Function.
‘total charge’ means
the estimated total value of all services to be
supplied calculated with reference to the guaranteed
minimum number of guests.

facilities: the
host needs to provide the company all required
facilities and equipment for food preparation.

3. |
provisional booking:
the company shall hold a provisional booking for
not more than 14 days until the company received
signed contract from the host accepting the companies
quote and terms and conditions. the company reserves
the right to change any of it’s prices on
reasonable notice to the client. all prices quoted
are inclusive of vat.

4. |
minimum numbers:
the company operates a policy of catering for
a minimum of 10 guests at all times, and charges
will reflect this minimum number if guest numbers
attending fall below this.

5. |
payment request:
payment terms are 50% of the entire cost 14
days prior to the event with the balance paid
on the day. payment is accepted by cheque or
cash.

6. |
food waste:
after any function remaining food will be disposed
of by the company, if the host retains food remains
the host revokes any claim on the company for
food related illness.
|
7. |
cancellation:
in the event of cancellation by the host of a
confirmed booking the deposit will be retained
by the company.
|
8. |
final numbers:
the host must confirm the final number of guests
to the company 4 days prior to the function.
|
9. |
damage:
the company cannot be held responsible for any
damage of property or equipment whilst on-site
at the hosts venue.

10. |
indemnity:
the host shall indemnify the company and its directors,
officers and employees against all charges, claims,
damage, liabilities, proceedings, demands, fines,
fees, costs or expenses (to include legal expenses
on a solicitor and own client basis) including
but not limited to, loss or goodwill, loss of
profit and loss of opportunity suffered by the
company directly and indirectly as a result of
any breach of these terms and conditions of trading
and / or the negligence or wilful default of the
host or any of its guests.

force majure:
the company may rescind its contract with the
client if it is prevented, hindered or delayed
from performing any of it’s obligations
under the contract by a force majure event.

expenses: travel expenses incurred
for travel to any destination outside hampshire
will apply at 15 pence per mile, this charge will
be added to the invoice. additional charges incurred
by dinnerpartease for parking, road tolls, or public
transport will be passed on to the host.

13. |
these terms and conditions
of trading shall apply at all times and may only
be revised or amended in writing providing written
consent is given by an authorised representative
of each party. |
